Seizing a Pistol

  • A pistol may be seized and forfeited for any violation.
  • Exception - The officer should not seize the pistol for failing to carry the pistol license if:
    • The person has a valid Michigan driver's license or ID AND the pistol license is verified in LEIN.
  • Note: The officer may still issue the gun holder a civil infraction for failure to carry their pistol license.
  • If the officer cannot verify if a license has been issued, the pistol should be seized. The person has 45 days to produce his license, otherwise the pistol may be forfeited.
